Some time ago in a previous article, I shared the 3 Film Insurance Policies Every Filmmaker Needs. When I wrote the article, the sexual misdeeds of those in Hollywood were just coming to light, and it seemed at the time, that they were contained. However, the number of sexual harassment claims has unfortunately grown and it’s become an absolute must for every production to have Employment Practices Liability Insurance (EPLI).
What is EPLI?
EPLI covers the costs that arise from a sexual harassment lawsuit or one involving invasion of privacy.
Film producers have to think more about how a single incident can result in an expensive lawsuit. After all, it only takes an off-color remark or an ‘office romance’ to create a situation that could cost your production a lot of money. EPLI is relatively inexpensive in comparison to what it could cost if there is an issue.
Sexual Harassment
As stated, EPLI covers the cost of defending your production company in the event that a sexual harassment lawsuit is brought against your film production. It covers legal fees and any damages awarded in court.
Invasion of Privacy
EPLI also applies to invasion of privacy claims.
Let’s say you fail to properly document your drug-screening policies and one of your cameramen fails a random drug test. They can then cry “deception.” This doesn’t just apply to drug screenings. Any omission of employee information, whether on purpose or not, could result in a lawsuit.
Also, if you maintain sensitive information, such as your crew’s SSNs, you need EPLI. All it takes is one cyber breach and they can claim “invasion of privacy.” Or, let’s say that same third-party drug screening company leaks their medical information. Guess what? They can sue you for not keeping their information private.
Another type of privacy issue is the use of video cameras. Many sites will set up cameras to prevent theft. However, if your cameras accidentally capture behavior, such as a lunchtime tryst, those that were filmed could bring an invasion of privacy suit against you.
EPLI takes care of all these situations.
